Terms of Service for StyrX

1. Acceptance of Terms

By accessing and using the StyrX mobile application ("App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

StyrX is an IoT device management platform that allows users to:

  • Monitor and control connected IoT devices
  • Manage device configurations and settings
  • Track subscription status and data usage
  • Receive real-time notifications and updates

3. Account Registration

3.1 Account Creation

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • One account per user; multiple accounts are not permitted without authorization

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payments

4.1 Subscription Plans

  • StyrX offers various subscription plans with different features and pricing
  • Subscription details, including pricing and features, are available within the App
  • Prices are subject to change with 30 days' notice

4.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • Payment is processed through our billing partner, Tripletex
  • You authorize us to charge your selected payment method automatically
  • Failed payments may result in service suspension

4.3 Refunds and Cancellations

  • You may cancel your subscription at any time through the App or by contacting support
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial subscription periods, except as required by law
  • Free trial periods, if offered, may be subject to additional terms

5. User Responsibilities

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Use automated systems (bots, scripts) without authorization
  • Reverse engineer, decompile, or attempt to extract the source code
  • Share your account credentials with others

5.2 Device Usage

  • You are responsible for the proper use of IoT devices connected to your account
  • You must ensure your devices comply with local regulations and safety standards
  • We are not liable for damages caused by improper device configuration or use

6. Data and Privacy

6.1 Data Collection

  • We collect and process data as described in our Privacy Policy
  • By using the App, you consent to such collection and processing

6.2 Device Data

  • Device configurations, settings, and usage data are stored to provide the service
  • You retain ownership of your data
  • You may request data export or deletion as described in the Privacy Policy

7. Intellectual Property

7.1 Ownership

  • The App, including all content, features, and functionality, is owned by TrioWeb AS
  • Our trademarks, logos, and service marks are protected by intellectual property laws
  • You may not use our intellectual property without prior written permission

7.2 Limited License

  • We grant you a limited, non-exclusive, non-transferable license to use the App
  • This license is for personal, non-commercial use only
  • The license may be revoked if you violate these Terms

8. Service Availability

8.1 Uptime and Maintenance

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • We are not liable for service interruptions due to circumstances beyond our control

8.2 Service Modifications

  • We reserve the right to modify, suspend, or discontinue features at any time
  • Major changes will be communicated to users in advance
  • Continued use after modifications constitutes acceptance of the changes

9. Limitation of Liability

9.1 Service "As Is"

  • The App is provided "as is" without warranties of any kind
  • We do not warrant that the App will be error-free or meet your specific requirements

9.2 Liability Limitations

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not responsible for damages caused by device malfunction, misconfiguration, or third-party services

9.3 Exceptions

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

10. Third-Party Services

  • The App may integrate with third-party services and APIs
  • We are not responsible for third-party services' availability, accuracy, or content
  • Third-party services are subject to their own terms and conditions
  • Current third-party integrations include:
    • IoT device communication networks (1NCE)
    • Accounting and billing (Tripletex)
    • Error monitoring (Sentry)

11. Termination

11.1 Termination by User

  • You may terminate your account at any time by contacting support
  • Upon termination, your subscription will remain active until the end of the billing period

11.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • Your account is used for fraudulent or illegal activities
  • You fail to pay subscription fees
  • We discontinue the service (with 90 days' notice)

11.3 Effect of Termination

  • Upon termination, your access to the App will cease
  • We may delete your data in accordance with our retention policies
  • You may request a data export before termination

12. Changes to Terms

  • We may update these Terms from time to time
  • Material changes will be notified through the App or via email
  • Continued use after changes constitutes acceptance
  • The "Last Updated" date at the top indicates the latest revision

13. Dispute Resolution

13.1 Governing Law

  • These Terms are governed by Norwegian law
  • Any disputes shall be subject to the exclusive jurisdiction of Norwegian courts

13.2 Informal Resolution

  • We encourage you to contact us first to resolve any disputes informally
  • Most concerns can be resolved quickly through our support channels

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and TrioWeb AS regarding the App.

14.2 Severability

If any provision is found to be unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

14.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations to any party.
